Frequently Asked Questions for HR Directors

Do I need to tell my legal department?

Recommended but not required. You may want to loop in your counsel before announcing the platform or as concerns are filed. Your legal team can advise on response strategy and help ensure compliance with your organization's policies. You can consult your own counsel at any time.

What if an employee files something frivolous?

You can respond explaining your position through the portal. The platform records your response and when it was sent.

Can I require employees to use this before filing a lawsuit?

No. Wiser Workplace is a voluntary resource for employees. Do not make it a condition of employment, write it into a handbook or policy, or treat it as a required step before an employee may raise a concern with a government agency or a court; an employee's right to do so does not depend on any channel you provide. Making the platform available and well-publicized may reduce litigation by providing an accessible alternative for resolving concerns informally.

What happens to my data if I cancel?

You retain access to your records in the portal through the end of your billing period. Use of those records remains subject to Terms Section 7.

Does this replace our internal HR complaint process?

No. Wiser Workplace is an additional, independent channel for employees to raise concerns confidentially. An employer can use both; the internal HR process and Wiser Workplace complement each other. Employees may prefer a confidential channel outside your HR system, while you benefit from the documented resolution process.

How does this affect my insurance or liability?

Check with your professional liability and employment practices liability insurance carrier. Documented response timestamps can support an organization's internal compliance review.

Can employees remain anonymous?

The employee is identified to the platform, and that is deliberate. Wiser is non-anonymous by default. An anonymous tip channel produces a report you often cannot act on; this platform is built to produce a conversation and a written record, which requires the platform to know who the parties are.

What the employee gets is confidentiality rather than anonymity, and the two are not the same thing. Under Section 7 of the Terms of Service, the identity of the parties and the existence and nature of the concern are Confidential Information binding on both sides. The platform does not show you the employee's name, email address, or phone number. You receive the submission, and anything the employee later sends through the platform, as written, and that may identify the employee. The platform does not otherwise disclose the employee's identifying information to you, except as required by law or court order. If you need an anonymous tip line for SOX or Dodd-Frank purposes, keep the one you have; this is a different instrument for a different problem.
