Mediation is not a substitute for consulting your own attorney. We strongly recommend that all users - both employees and employers - consult with independent legal counsel before making decisions based on information from this platform, and before signing any resolution or settlement agreement.

Mediators on the platform are independent professionals. They are not employees of Wiser Workplace and are solely responsible for their own qualifications and conduct.

1. Wiser Workplace is Not a Law Firm

Wiser Workplace is a California-based employment dispute resolution platform, not a law firm. We provide a neutral platform for employees, employers, mediators, and attorneys to collaborate on workplace issue resolution.

Information vs. Legal Advice: Wiser Workplace provides educational information, general guidance, and tools to help you understand workplace issues. This information is not a substitute for legal advice from a licensed California attorney. Specific legal advice requires a formal attorney-client relationship.

Our Role: We help facilitate communication, offer educational resources, connect people with mediators and attorneys, and provide tools for resolution tracking. We do not represent anyone in legal disputes.

2. No Attorney Referral Service

Fee Structure: Wiser Workplace is free for employees. Employers pay subscription fees for platform access. All fees are clearly disclosed before use.

3. Mediator Qualifications & Mediation Confidentiality

California Evidence Code §§1115-1128: Mediation Communications Confidentiality

  • Mediator Independence: Mediators using the Wiser Workplace platform are independent professionals, not employees of Wiser Workplace. Wiser Workplace does not control mediator conduct or guarantee mediation outcomes.
  • Mediator Qualifications: Mediators should have appropriate training, experience, and knowledge of employment law and conflict resolution. We recommend discussing mediator qualifications, experience, and approach before engaging.
  • No Guarantee of Settlement: Mediation does not guarantee resolution. Parties may resolve some, all, or none of their disputes through mediation. If mediation does not result in settlement, parties may pursue other remedies (litigation, arbitration, agency complaints).
  • Binding Agreements: If parties reach a mediation agreement, that agreement may be legally binding and enforceable. Before signing a mediation agreement, you should consult with an independent attorney to understand your rights and obligations.
  • Confidentiality Duration: Mediation confidentiality continues even after mediation concludes, except where legally required disclosures apply (such as to law enforcement for imminent harm).

4. No Guarantees of Results

  • Past Results Do Not Guarantee Future Outcomes: Any case statistics, settlement examples, or past results described on this platform are illustrative only. They do not predict or guarantee similar results in your case.
  • Variables Affecting Results: Resolution amounts and outcomes depend on factors including: strength of evidence, applicable law, witness credibility, damages calculation, venue, cost to litigate, and negotiating positions of both parties.
  • No Predictions: No prediction has been made as to the probable success or failure of your case. Only an attorney who has reviewed your specific facts can provide legal analysis.
  • Tool Results Are Estimates: Settlement calculators, case screeners, and other tools on our platform provide estimates based on general data. They do not analyze your specific situation and are not predictions of outcome.
  • Tax & Other Consequences: Wiser Workplace does not provide tax advice. Settlement amounts may have tax consequences that vary based on individual circumstances. Consult a tax professional for advice.

7. Privacy & Data Protection

California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA):

Your privacy is important to us. Information you provide through Wiser Workplace is subject to our Privacy Policy, which complies with California privacy laws and federal data protection standards.

8. Arbitration & Class Action Waiver

Please review the complete Terms of Service for our arbitration clause and class action waiver. These provisions govern disputes between you and Wiser Workplace regarding this platform and our services.

These provisions do not apply to your disputes with other parties (employers, employees, mediators, attorneys). Those disputes are governed by applicable law and any agreements with those parties.
