Our Role Under the DMCA

Wiser Workplace is an online service provider under the Digital Millennium Copyright Act (DMCA), 17 U.S.C. 512. We respect the intellectual property rights of others and expect our users to do the same.

If you believe that material accessible on or from the Wiser Workplace platform infringes a copyright that you own or control, you may submit a written notice of claimed infringement to our designated agent using the information below.

Requirements for a Notice of Claimed Infringement

To be effective under 17 U.S.C. 512(c)(3), a notice must be a written communication that includes substantially the following:

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright interest that is allegedly infringed.
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple works are covered by a single notice, a representative list of such works.
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity, with information reasonably sufficient to permit us to locate the material.
  4. Your contact information, including name, mailing address, telephone number, and, if available, an email address.
  5. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notice is accurate, and, under penalty of perjury, that you are authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.

What Happens After We Receive a Notice

  1. We review the notice for substantial compliance with 17 U.S.C. 512(c)(3). If the notice is non-compliant, we may request corrections from the sender.
  2. If the notice is substantially compliant, we will expeditiously remove or disable access to the identified material.
  3. We will notify the user who posted the material and provide a copy of the notice along with information about the counter-notification process.

Counter-Notification

If you are a user whose material was removed or to which access was disabled in response to a DMCA notice, and you believe the removal was the result of mistake or misidentification, you may submit a counter-notification to our designated agent at the address above. Your counter-notification must include, per 17 U.S.C. 512(g)(3):

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access to it was disabled.
  3. A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the United States District Court for the judicial district in which your address is located, or, if your address is outside the United States, for any judicial district in which Wiser Workplace may be found, and that you will accept service of process from the person who provided the original notice or an agent of that person.

Upon receipt of a compliant counter-notification, we will follow the process required by 17 U.S.C. 512(g), which may include restoring the removed material if no court action is filed within the statutory period.

Repeat Infringer Policy

Consistent with 17 U.S.C. 512(i), Wiser Workplace has adopted and will reasonably implement a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers. Decisions under this policy are made on a case-by-case basis and may take into account the number and nature of notices received, any counter-notifications, and the context of the claimed infringement.
